Puerto Rico minimum wage 2026: calculate your take-home pay

How much it is today

Puerto Rico stopped depending on the federal minimum with Act 47-2021, which created its own state minimum wage with scheduled increases: $8.50 in 2022, $9.50 in 2023 and $10.50 per hour since July 2024. That $10.50 is the current base for most private-sector employees.

The same law created a Minimum Wage Evaluation Commission with the power to decree further increases, so the figure can keep rising by decree without a new statute. Before negotiating or filing a claim, confirm the current figure with the Department of Labor; it is the official source and publishes it.

Who it covers and who it does not

The general rule covers private-sector employees covered by the federal Fair Labor Standards Act (FLSA). Some groups are treated differently: tipped employees have a different structure where tips supplement the base wage, and sectors like agriculture have had their own scales and dates under the same law.

A minimum also does not stop a job from paying more, and many do. On MyPRjobs you can filter by hourly pay to see only jobs advertising above-minimum wages, and manufacturing job fairs usually announce their base rate right on the flyer.

If you are paid less

Paying below the applicable minimum is not negotiable or 'how this place works': it is a violation you can claim. Keep your pay stubs and your own record of hours (photos of the punch clock, shift messages; everything helps), because the difference is calculated hour by hour.

The complaint is filed with the Department of Labor and Human Resources, you do not need a lawyer to start, and the law prohibits retaliation for claiming. If you are fired or your hours are cut for claiming, that becomes an additional claim, not the end of yours.

Frequently asked questions

Wasn't the minimum wage $7.25?

$7.25 is the federal minimum. Since Act 47-2021 Puerto Rico has a higher state minimum, and when two minimums apply, the higher one governs. For most private jobs on the island, the state figure is the base.

Does the minimum apply the same way if I earn tips?

Not exactly. Under the federal Department of Labor table for tipped employees (July 1, 2026 version), in Puerto Rico the minimum cash wage is $2.13 per hour, the maximum tip credit is $8.37, and the combined figure you must reach is still $10.50.
